Customer Design Contracts

Hi,

I've done a bit of work here and there, but have not had any contracts signed. Doing work without a contract in place is dangerous and I'd like to get a few together for the different types I do. However doing searches for legalese ideas is difficult as "drafting, draftsman, design" all refer to the art of assembling a contract. What are you using in your contract language?

The types of work I do:

1. Homeowner has own ideas and I draft construction documents using 3d fly-throughs as clarifier's.
2. Homeowner has no Idea. Design and Documents.
3. Designer, Architect or Engineer does not have the capability to make 3d visuals.
4. As-built floor plans for Commercial and Residential properties.

Not in your business line but when researching for my own help found this http://www.legalzoom.com for some things. Maybe it can help?? Think the first decision is time and material, fixed price, cost plus etc. Do you have to protect from liability etc

I remember downloading a professional services agreement template a while ago. It was for 3D vis services, but it could be adaptable for your purposes. It took a bit of digging around my hard drives, but I managed to get the source - it is on the http://3dats.com/tutorials.asp site in their tutorials section. Scroll down to the Week 4 item.

Thanks! That's super helpful! It seems that the main liability would be related to errors and omissions. The sample 3d vis contract gets around that by receiving the information in cad form from the client. I wonder if anyone has any insight on how to protect yourself if you do an on-site takeoff.
