Animation w/ music?

I've got a project that the client is wanting to do a quick animation for w/ a particular Neil Young song in the background. I think I know how to do that software wise, but what I'm really wondering is if anyone knows how to do that...er...legally.

There is a lot of discussion about lots of this stuff right now in the legal world. I think the old legal answer is that you would need to pay a royalty somehow. Nowadays the answer might be that it depends on the artist and the record label they work under. Some artists don't mind their music being used for kind of stuff at all w/o royalty. But if it were a prince song, you would get in trouble as soon as his people saw you use his song w/o paying royalties and they would absolutely sue you (they sued a mom who put a short clip of her baby dancing to a barely audible Prince song in the background on Youtube and she was promptly sued.....Prince lost because she used it within the built in guidlines of fair use). Anyhow, I don't know if that helps. I think that you can do it, and if they think that it is illegal, all they do is hit you with a cease and desist under the DMCA (Digital Millenium Copyright Act in the USA).
Is this going to be something released to MTV for your own profit? Or is it more like a small personal project, maybe presented to some clients? Or is it going to YouTube to try and be #1 or something? A lot of times it seems the intent and size of the project (how many people are going to view the content) plays in to if you get hit with a cease and desist.
Overall, I'd not worry about it at all if it is a small project.

Im with chris on this, in that i think its largely an issue of scale. Hopefully its fairly obvious that if you plan on showing the vid in a very public place or broadcasting on TV then its a must to get in contact and pay some royalties, the reverse also applies.

Interesting about the directory. Basically it's an animation that may very well be used promotionally to show off the architects design via his website. I would think that would make a good enough candidate to get ahold of ol' Neil and maybe spot him a couple bucks. Anyone got his number? I seem to have lost it somehow.
Seriously though, anyone have any idea on how to actually go about paying the royalties then or perhaps to get my paws on this directory? If I find out I'll report back but if anyone has any clues or links they're appreciated.

PS. too bad about that lady w/ the kid on youtube. too bad she got off scott-free that is. Posting videos of your kids on youtube should be a felony under the People's Right to Not Make me Gag Act 1997 established by the quasi-famous Gray vs. America's Funniest Home Videos case.
