You may be aware of the context from which this came.
If not, the story is here: http://news.bbc.co.uk/1/hi/technology/8533695.stm

Had not heard about this before now, based on the little I have read and possibly with a bias, it does sound ridiculous.

I don't agree with the ruling at all. They got the video down and the bullies were caught, what more do they want. It's ludicrous to expect that the millions of videos can be screened and filtered in seconds, minutes, an hour. It took youtube about 20-30 minutes even more in some cases to take down porn...i say again PORN. If it takes that long for porn it is normal to take down other videos which are debatable in content in hours or even days.
I really hate this trend of stomping on freedom and human rights because of a few cases, which all in all on the world scale are not that important and not a generalized phenomenon.

Next, they'll be charging people for abetting a crime just for witnessing it.

My question is... if You tube did not exist, would the fight have been taped? I think that the You Tube phenomenon encourages folks to exhibit these things, not saying it caused the fight rather thanks to You Tube the perps have been apprehended whereas if it was not taped it may have gone unresolved.
just throwing out a thought.

You have a point SOLO. In my country there have been quite a few fights and other acts at school caught on "tape" with mobile phones and then posted on line. Very few were made just for the fun of posting them on the web.
They mostly helped us to become aware of some problems in our society and institutions. If they wouldn't have been shown then no action would have been taken.
Even so I don't think this type of content should be encouraged, but not be completely repressed either.
